🟧 개요
지적재산권 제도는 기술 혁신과 기술 이전을 목적으로 합니다. 하지만, 지재권 제도가 기술의 혁신과 이전을 자동으로 보장하지는 않습니다. 제도를 어떻게 설계하고 운영하느냐에 따라 기술 혁신을 촉진할 수도 있고 저해할 수도 있습니다. 1995년 세계무역기구에서 트립스 협정(TRIPS Agreement, 무역관련지적재산권협정)을 통해 지재권을 무역 규범의 하나로 묶으면서 약속했던 기술 이전은 지켜진 적이 없습니다. 트립스 협정으로 인해 지재권을 통한 기술의 사유화와 상업화가 강화되었고, 의약품 특허가 의무화되었습니다. 이로 인해 의료 기술의 공공성은 점차 무너지고 있습니다.
지재권을 통한 의약품의 독점은 필요한 의약품을 적정한 가격에 이용하지 못하도록 합니다. 코로나19 백신이 공공재가 아니라 일부 제약사의 독점 상품처럼 취급되는 배경에도 지재권이 자리잡고 있습니다. 앞으로 시장에 등장할 코로나 치료제 역시 마찬가지입니다. 지재권으로 무장한 시장 독점 중심의 의약품 생산은 이른바 ‘소외 질병’(neglected disease)을 낳아, 지불할 능력이 없는 사람들이 걸린 질병에는 의약품이 개발되지 않습니다. 의약품의 독점 가격은 이제 잘 사는 나라들도 감당하기 어려울 정도로 치솟았습니다.
우리 사회의 지식·정보의 생산과 소비 방식을 결정하고 삶의 질에 중요한 영향을 미치는 지재권 제도는 난해한 법률 문서로 포장되어 이해하기가 너무 어렵습니다. 지재권 제도로 인해 의료기술의 공공성 무너지는 지점이 어디인지, 공공성 회복을 위해 무엇을 해야 하는지 실천 전략을 짜려면 지재권 제도를 알아야 합니다. 『지식연구소 공유개방』과 『연구공동체 건강과대안』은 지재권 제도를 구성하고 있는 난해한 법률포장을 뜯어내고 지재권 제도의 본질을 파헤치는 무료 강좌를 마련했습니다. 강좌는 기본 강의와 특강으로 구성됩니다. 기본 강의는 지식연구소 공유개방 소장의 직강으로 진행되고, 특강은 의료기술과 지재권 분야의 해외 전문가를 초빙하여 진행됩니다.
특강은 고려대학교 BK21 의과학교육연구단, 러닝헬스시스템융합연구단, 국제학교육연구단, 서울대학교 BK21 건강재난 통합대응을 위한 교육연구단이 공동 주최로 함께 합니다.

She has 15 years of research and advocacy experience in intellectual property and public policy matters, in particular, access to medicines. She monitors and engages with international discussions at the World Health Organization, World Intellectual Property Organization and the World Trade Organization. She has authored and contributed towards several publications including Pandemic Preparedness: Creating a Fair and Equitable Influenza Virus and Benefit Sharing System. Dr. Hu Yuan Qiong works as Senior Legal and Policy Advisor, Policy Coordinator for the Access Campaign of Médecins Sans Frontières (MSF/Doctors without Borders). She is also affiliated with the Law, Environment and Development Centre at the Law School, School of Oriental and African Studies, University of London. Her expertise concerns the interactions of human rights, intellectual property, access to medicines and innovation. |

The current focus is on the financing of research and development, intellectual property rights, prices for and access to new drugs, vaccines and other medical technologies, as well as related topics for other knowledge goods, including data, software, other information protected by copyright or related rights, and proposals to expand the production of knowledge as a public good. James Love holds a Masters of Public Administration from Harvard University’s Kennedy School of Government and a Masters in Public Affairs from Princeton’s Woodrow Wilson School of Public and International Affairs. |
